Warner Bros. Loses Superman Origin Rights

According to Variety, an ongoing Federal court battle over Superman ended when Judge Stephen Larson ruled Wednesday that the family of the superhero's co-creator, Jerry Siegel, has "successfully recaptured" rights to additional works, including the first two weeks of the daily Superman newspaper comic-strips, as well as portions of early Action Comics and Superman comic-books.

The ruling is based on the court's finding that these were not "works-made-for-hire" under the Copyright Act.

This means the Siegels -- repped by Marc Toberoff of Toberoff & Associates -- now control depictions of Superman's origins from the planet Krypton, his parents Jor-El and Lora, Superman as the infant Kal-El, the launching of the infant Superman into space by his parents as Krypton explodes and his landing on Earth in a fiery crash.

The first Superman story was published in 1938 in Action Comics No. 1. For $130, Jerry Siegel and co-creator Joel Schuster signed a release in favor of DC's predecessor, Detective Comics, and a 1974 court decision ruled they signed away their copyrights forever.

In 2008, the same court order ruled on summary judgment that the Siegels had successfully recaptured (as of 1999) Siegel's copyright in Action Comics No. 1, giving them rights to the Superman character, including his costume, his alter-ego as reporter Clark Kent, the feisty reporter Lois Lane, their jobs at the Daily Planet newspaper working for a gruff editor, and the love triangle among Clark/Superman and Lois.

While ownership of the Man of Steel is one point of all this legal activity, the real issue is money and how much Warner Bros. and DC owe the Siegels from profits they collected from Superman since 1999, when the heirs' recapture of Siegel's copyright became effective.

DC owns other elements like Superman's ability to fly, the term kryptonite, the Lex Luthor and Jimmy Olsen characters, Superman's powers and expanded origins.

In a statement, Warner Bros. and DC said, "Warner and DC Comics are pleased that the court has affirmed that the vast majority of key elements associated with the Superman character that were developed after Action Comics No. 1 are not part of the copyrights that the plaintiffs have recaptured and therefore remain solely owned by DC Comics."

    i don't blame the Siegels at all. They did create the worlds' first comic SUPERHERO! (certainly the oldest continuing one). Since they didn't get paid sh*t on day 1.
    My only concern is will this effect the new films getting made? Not like they could be worse than S.RETURNS anyway

    I just seriously can't believe this. I mean Superman' whole incantation is in DC Comics, why would the Siegel Estate want to f*ck that up? Also what's up with the Shusters? I mean I thought Shuster co-owned Supes with Siegel.

    As far as what it states that DC still owns the expanded origins, its hard to say really what that entails. They might involve the Brainiac/Kandor storyline, or other stuff completely. If only DC had made a comic mini-series that went into detail about Superman's origins and remained in canon to this day. They are making "Superman: Secret Origin" which is supposed to come out soon, but now who knows, anyway that is only from Clark's perspective as he grows up in Smallville so no Krypton stuff is in that.

    I wish all this would get settled already. Anyone looking for definitive Superman material, check out "Superman: Last Son," it was written with Richard Donner who made the first 2 movies and the art is spectacular and story is rich. I have the digital file, if anyone is interested just msg me.

    It is pretty hard for writers these days. Newkill is partially correct you need contacts, these days it doesn't matter about your education, as long as you know how to do your job and are dedicated to it.

    From my own personal experiences, i think its the way you personificate yourself to the producers or how you appeal to them in ypur proposal, treatment, pitch etc.
    They need to know your not some next dickhe*d just wasting their time, they need to know your serious about this.

    But the thing is with all these lawsuits attacking Superman, Warner, DC between the Siegel family is just f*cking up the whole process of making a brilliant Superman film, that we all so yearn for.

    Also further note sriske is correct, Supes never started off flying, i've been recently reading the complete Action & Detective comics online, but i can't imagine Supes jumping building to building in the next film or free-running from building to building lol

    Ok friends lets not get our panties in a twist quite yet. The orgianl Action Comics concept of Superman is that he could leap tall buildings in a single bound. Out run a speeding bullet, and abnormally strong. In the comic he was only strong enough to lift a car over his head. His abilities have changed with each passing year, but 1st flight for Superman didn't start till the 1940s in an animated series. Like all of you I am too still waiting for a good Superman film. I say lets give Lock and Stock a chance.

I believe that you have a draft, but seriously, i don't think you have any idea how the film industry works man. yOu could have all the support from every user on this site and maybe the more sites, but that still wouldn't mean the film would get in. It's so hard now today to just have someone read a . These days the best way to really get ahead and strive is first off, move to L.A., because if you live anywhere else trust me you won't get anywhere, secondly, it would be really great if you knew someone who's already big in Hollywood. Best of luck to you, because if there's one thing i want before i die is a Superman movie that lives up to the greatness as the first two movies were.
