Warner Bros. and DC Lose Certain Superman Rights

Warner Brothers and DC comics have lost a little bit of Superman, and could lose him completely come 2013. Judge Stephen Larson has given Superman's co-creator Jerry Siegel rights to additional works in the franchise, including the first two weeks of the daily Superman newspaper comic strip and early issues of both Action Comics and Superman comics. According to Variety, this means that the Siegel estate now owns the rights to all depictions of Superman's origins from the planet Krypton, his parents Jor-L and Lora, Superman as the infant Kal-L, and the launching of the infant Superman into space by his parents as Krypton explodes and his landing on Earth in a fiery crash.

What this means for Warner Brothers and DC Comics is that they've lost a little more control over certain aspects of the Superman character. DC still owns other important elements like Superman's ability to fly, the term kryptonite, the Lex Luthor, Jimmy Olsen and Perry White characters, Superman's vision powers and expanded origins. The main point to this lawsuit is figuring out how much the Siegels are owed from profits WB and DC collected from Superman since 1999, when the heirs legally took back half of the Superman copyright.

In a statement, the two companies said, "Warner and DC Comics are pleased that the court has affirmed that the vast majority of key elements associated with the Superman character that were developed after Action Comics No. 1 are not part of the copyrights that the plaintiffs have recaptured and therefore remain solely owned by DC Comics." That is all well and good, but copyright law dictates that full ownership of Superman goes back to the Siegels in 2013. This will give the Siegels the chance to set up Superman pics, TV shows and other projects at another studio away from Warner Brothers.

In order to get a new Superman or even Justice League film featuring the superhero off the ground, Warner Brothers and DC will have to get the project into production by 2011.

Superman was released December 15th, 1978 and stars Marlon Brando, Gene Hackman, Christopher Reeve, Ned Beatty, Jackie Cooper, Glenn Ford, Trevor Howard, Margot Kidder. The film is directed by Richard Donner.

    Well this news is some crapper in DC & Warners letterbox.

    I agree with CBF, this film needs to start rolling and it needs some epic closure not an epic dark origin.

    I don't like the thought also of the Siegels being able to ship it around to other studios, know Jerry Siegel being the kind of dunce he is i'm mean come on he sold Superman for how much back in the day, he'll probably be such a dunce and sell the rights to Fox.

    This should stay with Warner even if the Siegels claim rights because this gives them so much more creative power and also the alliance for not only a World's Finest Film but also a Justice League film some day.

    This is so weird. I can't even picture DC without Superman. If they do lose the rights in 2013 it would be a huge shake up in the comic book industry. I can't imagine a Superman without his DC connections. This wasn't welcomed news at all.

    If they actually cared about the character they'd be more insistent that WB take better care when making movies about him, and actually try to get something good for the character pushed through. I hate the idea of these shmucks getting creative control over the origins, because they'll probably turn around and sell it to FUX.

    Okay so DC still owns the Brainiac and Zod storyline along with the Supergirl origin and Kandor. That's all fine and dandy, but DC can't decide what Supes' official origin is and what is not as it is. I mean they retconned him with "Man of Steel," "Birthright" and then again with "Last Son", and then further with "Superman: The Movie," which wasn't all DC but more WB but it still counts.

    I'm all for a great Superman story, especially one revolving his origins. But if this stint is true (which I know it is as the Siegel estate has been desperately trying to recover the rights since the late 90s), that means that only one more film can be made by WB/DC and it needs to go into pre-production by 2011 in order to come out BEFORE 2013, when Siegel will own the FULL RIGHTS to the character.

    So, that begs the question: why would they choose to do a reboot film when they can't make any sequels? No, if this is to be the last film, we need a closure epic. I liked Routh as Clark but I think the next film needs more action and richer story minus the kid in the sequel to "Returns."

    Quick: Someone call Richard Donner, cuz I don't think this film's getting made.
