Disney doesn't have the rights to Silver Surfer, Fox does. Unless they're conjuring some clandestine deal, you won't see Silver Surfer in any of these movies.

They did a brilliant job on both objects. I'm particularly interested in knowing how they will use the Infinity Gauntlet. It obviously conjures up thoughts of Thanos being involved, but I also wonder if they will place Silver Surfer somewhere in this, even if it's just a cameo moment warning of Thanos' coming.

This in my opinion is a gateway for Thanos to be the villian in The Avengers. Joss Whendon is a big fan of outer space elements and can introduce cosmic characters of the Marvel universe. Also it would make perferct sense for these heroes to assemble.
